The administrative body incorrectly and unlawfully assumed that the applicant was an accompanied minor. Article 44, paragraph 9, clause 3 of the Law on Foreigners in the Republic of Bulgaria (LFRB) explicitly prohibits the forced placement of unaccompanied minors and juveniles. Instead, the authority must refer the person to the competent Social Assistance Directorate, which is required to implement child protection measures. The failure to comply with this imperative provision rendered the detention order unlawful and annulled it.
