The administrative body incorrectly and unlawfully treated the applicant as an accompanied minor, which was not the case. This violated Article 44, paragraph 9, clause 3 of the Law on Foreigners in the Republic of Bulgaria (LFRB), which prohibits detention of unaccompanied minors and mandates their referral to the Social Assistance Directorate. The violation of this mandatory provisions rendered the detention unlawful and it was therefore annulled by the court.
