On 10 April 2024, the Court of Appeal in Białystok increased compensation for the illegal extended detention of an Afghan family, awarding PLN 20,000 per person, totalling PLN 100,000. The family, consisting of parents and three children who fled Afghanistan in July 2021 due to fears of a Taliban takeover, was detained in a migrant centre for 97 days after crossing the Polish-Belarusian border. The court determined that detention was justified only for the first month, mandating that the family should have been released immediately once the parents’ identities were confirmed. This decision revises the earlier ruling by the Olsztyn Regional Court, which had granted only PLN 6,500 per person as a symbolic compensation for wrongful detention. The judgment underscores the severe negative impacts of prolonged detention and the systemic issues in the treatment of migrants in Poland.
