An Afghan teenager, who stated he was 15, was wrongfully detained in an adult guarded center for 108 days based on a flawed wrist bone examination that misclassified him as an adult. Despite applying for international protection, his detention was prolonged due to the risk of absconding —stemming from his lack of documents— and the presumption that his asylum claim was a tactic to delay his return. The Court noted that if his status as a minor without proper care had been duly acknowledged, appropriate legal safeguards would have been applied. In compensation for the physical and psychological distress he endured, the Court awarded him 10,000 PLN.
