The supervision of the execution of the ECtHR’s judgment in Darboe and Camara European lead the Committee of Ministers to “firmly” underline the authorities’ obligation to preventing further breaches of the absolute prohibition of inhuman or degrading treatment. In 2022, the ECtHR held that the 4-month of two unaccompanied minor migrants in an overcrowded reception centre for adult migrants constituted a violation of Articles 3, 8 and 13 of the ECHR. Therefore, the Ministers’ Deputies express their deep concern at the new provision enacted at the end of 2023 by the Italian Government, which has instead provided a legal basis for placing unaccompanied aged 16+ migrants in first reception centres for adults, for up to 5 months.
